Quando si applica la FIRPTA?
La FIRPTA può imporre ritenuta e adempimenti quando un soggetto estero cede un interesse immobiliare statunitense. Aliquota, base e possibilità di riduzione dipendono dalla struttura e dai fatti.
Come viene tassato in Italia un immobile negli Stati Uniti?
Un residente fiscale italiano deve coordinare redditi, plusvalenze, monitoraggio e imposte patrimoniali secondo il TUIR e le regole sul credito per le imposte estere.
Una LLC immobiliare evita la tassazione personale?
Non automaticamente. La classificazione della LLC può divergere tra Stati Uniti e Italia, con rischi di entità ibrida, CFC e disallineamento del credito.
Le imposte USA sono sempre detraibili in Italia?
No. Il credito dell’art. 165 TUIR richiede imposte estere definitive e il rispetto dei limiti italiani; base imponibile e periodo possono non coincidere.
